Parental Rights Group Pushes Back Against CPS with White House Petition

It is not just abusive parents who receive a knock on the door from social workers saying, “We’re here to take your children.” More often than not, children are taken from their families based on accusations that are unsubstantiated. Innocent parents can lose their children because they made an educational decision that someone didn’t like, asked for a second medical opinion for their child, or because someone made a false allegation against the parents.

According to the federal AFCARS report by the U.S. Department of Health and Human Services, less than 16% of children taken from their homes are taken for reasons of any kind of abuse.

Only 17% of allegations against parents nationally are substantiated or indicated.

Yet, numerous studies show that children in foster care are at least 6 times more likely to be abused, molested, raped, or killed in foster care than they are if they are left in their own homes, even if that home is a troubled home. See article:

We have come to a time in our history that the governmental agencies tasked with protecting children from being beaten and molested have themselves become the very instruments of placing children in harm’s way.

Group Launches White House Petition to Fight Back

All over America, families are pushing back. There is a groundswell of parents, grandparents, aunts, uncles, and former foster children who are saying that this has to stop. They are holding rallies, calling legislators, going to Congress, sharing their stories on social media and, increasingly, on mainstream media. Their voices are growing louder.

One organization, ParentalRights.org, has been working for decades to push back against the steady encroachment of state agencies into territory that was once held sacred – the family.

Recently ParentalRights.org launched a White House petition asking President Donald Trump to urge Congress to amend the Constitution to protect parental rights. According to White House policy, if the petition reaches 100,000 signatures within 30 days, the administration will issue an official update.

Their goal is to bring the issue to the President’s attention and get this vitally important conversation going. It is an achievable goal, but they need your help.

There are 10 days left. The petition closes November 23.

The petition says simply:

Ask Congress to amend the Constitution to include the right of parents to raise, nurture, and educate their children.

No one knows a child’s interests better than her parents. Yet children’s lives are turned upside down by investigators who second-guess reasonable decisions in education, medical care, and supervision. Poverty is too often treated as neglect to justify separating kids from parents instead of providing services. The child-welfare system disproportionately investigates minority children. Parents with disabilities face discrimination as well.

The role of parents in protecting their children is eroding—at great cost to children themselves—throughout the U.S. It’s time to protect children by empowering parents.

Mr. President, would you urge Congress to amend the Constitution to protect children by preserving the traditional liberty of parents to raise, nurture, and educate their children?

Role of Government to Secure, not Give, Rights

According to the Declaration of Independence, it is the proper role of government to secure the basic fundamental rights that we already have:

We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness. — That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed,….

The Supreme Court has already declared, repeatedly, that the right of parents to rear their own children is a fundamental right. In the landmark case, Troxel v Granville, 2000, Justices upheld this right, stating:

The Fourteenth Amendment provides that no State shall “deprive any person of life, liberty, or property, without due process of law.” We have long recognized that the Amendment’s Due Process Clause, like its Fifth Amendment counterpart, “guarantees more than fair process.” Washington v. Glucksberg, 521 U.S. 702, 719, 138 L. Ed. 2d 772, 117 S. Ct. 2258 (1997). The Clause also includes a substantive component that “provides heightened protection against government interference with certain fundamental rights and liberty interests.” 521 U.S. at 720; see also Reno v. Flores, 507 U.S. 292, 301-302, 123 L. Ed. 2d 1, 113 S. Ct. 1439 (1993).

The liberty interest at issue in this case–the interest of parents in the care, custody, and control of their children–is perhaps the oldest of the fundamental liberty interests recognized by this Court. More than 75 years ago, in Meyer v. Nebraska, 262 U.S. 390, 399, 401, 67 L. Ed. 1042, 43 S. Ct. 625 (1923), we held that the “liberty” protected by the Due Process Clause includes the right of parents to “establish a home and bring up children” and “to control the education of their own.” Two years later, in Pierce v. Society of Sisters, 268 U.S. 510, 534-535, 69 L. Ed. 1070, 45 S. Ct. 571 (1925), we again held that the “liberty of parents and guardians” includes the right “to direct the upbringing and education of children under their control.” We explained in Pierce that “the child is not the mere creature of the State; those who nurture him and direct his destiny have the right, coupled with the high duty, to recognize and prepare him for additional obligations.” 268 U.S. at 535. We returned to the subject in Prince v. Massachusetts, 321 U.S. 158, 88 L. Ed. 645, 64 S. Ct. 438 (1944), and again confirmed that there is a constitutional dimension to the right of parents to direct the upbringing of their children. “It is cardinal with us that the custody, care and nurture of the child reside first in the parents, whose primary function and freedom include preparation for obligations the state can neither supply nor hinder.” 321 U.S. at 166.

Child Protective Services Ignores Fundamental Rights

Though the Supreme Court consistently upholds parents’ fundamental right to raise, nurture, and care for our children, that right has not translated into the practice on the ground by Child Protective Services and the courts involved. In practice and reality, that right and other Constitutional rights are increasingly and routinely violated, as children are seized by social workers from non-abusive families.

This is why legislative and executive action is needed. The Supreme Court has upheld these rights, but lower courts, law enforcement, and the Child Welfare agencies funded by Congress act as though these rights are non-existent.

The 14th Amendment right to Due Process is all but ignored as a matter of practice. Children are frequently taken from their homes in violation of the 4th Amendment.

Social workers have told parents that the requirement to have a search order or warrant before seizing a child does not apply to Child Protective Services.

Just before she seized a newborn from a young mother, Alabama DHR supervisor Ahzshaka Evans told a mother:

we can summary remove, which means that we don’t have to have a court order. Only two people are allowed to do that: the Department of Human Resources of the state of Alabama and law enforcement. Those two people have the right to remove without a court order.” See story here.

In the infamous “Right to Lie” case, Pancy Linn, the attorney for a Child Protective Services social worker, argued that there is nothing in federal law or the Constitution that prevents a social worker from lying to courts about parents in order to seize a child. Judge Stephen S. Trott of the 9th Circuit Court of Appeals was incredulous at her line of reasoning.

In direct opposition to the argument often cited to parents embattled with CPS that “the Constitution doesn’t apply in Family Court,” Judge Trott stated:

No, no. In criminal proceedings? This is COURT proceedings, with a liberty interest, a fundamental liberty interest, at stake.

When parents are deprived of their fundamental liberty interests in raising their kids, the children are deprived of their own fundamental human right to the love and nurture of their parents. Parental rights ARE children’s rights.

How many more thousands of children will suffer the harm of being ripped away from their parents, relatives, homes, and heritage before our elected officials act? How many more hundreds of thousands of children will go missing, be trafficked, abused, killed, and experimented on before the fundamental right of parents to raise, nurture, and educate our children is secured?

Congress can write laws that secure this right. The President can call upon Congress to ensure the real protection of our children. For far too long, corrupt forces within the system have hidden in shadow, shrouded by the secrecy afforded them by policies purported to be “in the best interest of the children.”

The curtain has been drawn back. Oz can no longer hide. The wickedness within the system has been exposed.

  1. Need to stop the horrow CPS is causing children and the families. Please put a stop to them. They had the cops throw my grandaudaughter who was 5 month pregnant holding g her two kids ages 1 and 4 on my floor and throw a recliner over them. They had no search warrant and no court order. Please stop this.

When they came in and took my grandkids they did not have a search warrant or do a investigation they late at night and took them and I ask do you have a reason they said they didn’t need a reason and just started place in people care it was alful. The kids we crying cause they wanted to stay. With their mom an dad.

I was aworking through a temp agency for preston county dhhr as a clerk .my desk was 5 feet away from a cps workers desk .while I was doing data entry .I heard a cps worker talking to a friend on the phone .She was explaining how she was so worried about losing her car because she was behind in her Bill’s th er n she said but thank god that there was a placement that weekend that allowed her to make her placement ! I loved that job plus I was a registered foster parent for Burlington homes and my mother was a foster child …..but as I listened to the rest of the conversation the placement that had happened was a couple left their 5 year old with autism and a one year old baby with a babysitter and went fishing. On their way home the father was driving he had been drinking but the van went into a creek the mother died father was put in jail and instead of placing the kids with the grandparents .which lived7 miles away .she placed them in parkersburg in 2 separate homes ! To make her car payment with her mileage check ! The 5 year old had just started using the bathroom by herself and feeding herself which the trauma of being separated from her family she repressed back to wearing diapers and not eating ….
        But when I heard the gas check comment I’m sorry to say I couldn’t control my anger I choked her and yes I did threaten to harm her worse !
        This cps worker traumatized these children for a car payment! The grandparents wasnt even asked to watch them .the babysitter thought that was where she was taking them or she would have kept the children .
        Yes I had to talk to my supervisors where one told me not to talk about it and then the other ask me my side I didnt get one sentence out before the supervisor walked back in and fired me for insubordination…
        The cps worker did not lose her job ….
        They all are their for the money not the kids best interest !

        1. Horrible people they took my girls over false accusations from their mother. Then she got busted with meth twice and they went to foster care. Thank god they are with my bro now. Even though my rights are gone because of cps nd their false bs they are safe. I’d take care of cps and every one involved with those pukes myself with no care of my ending if anything ever happened to my daughters. Sorry for your family’s and anything bad that’s happened. It makes it hard to believe. I know.

  2. We have been fighting for the return of our 2 young children since July of 2018. We have completed our service plans, passed all drug tests including hair follicles and have never missed one single visit with our babies. They have been in foster care for 15 months now and we have only been allowed supervised (by the Dept) visitation with our now 3 yr old and 9 yr old. The entire 15 months!! During every visit, the monitor HAS to hear every single word spoken between us no matter if it’s out of our mouths or our kid’s mouths. It has also been forbidden for their father and I to attend any of our daughter’s school functions this entire time and if we ask any questions about the counseling she receives thru the Dept, we get our weekly visitation time cut in half and this punishment lasted for 3 months! Our caseworker used our visitation to punish us for 3 months!! She has also outright lied on the stand multiple times and has never been held accountable for her rottenness! There is nothing to do with “child’s best interest” involved with CPS!!

    1. Don’t give up, Crystal Walker. Keep fighting for your children and monitor carefully their foster care parents. This past Sept. 29, three year old twins Raelynn and Payton Keyes were found dead in Hinesville Ga. Their parents, Brian and Skye are totally devastated. The twins were taken from their parents in 2018, by CPS and placed with a single Jamaican women who was arrested for DUI and drugs a month prior to the girls death. She has since been arrested for murdering the children. Continue your fight. Go to your State legislators, even if you have to camp out at the State Capital building where you reside. Get a lawyer to assist you and if you cannot afford one, contact some local Christian agencies and churches for help. God bless you, and I will be praying for your children’s safety and return……Frank Mauro

  4. Dec 8th will be 3 yrs since I spent my last hour with my son when on all reality he should have never been taken. This nightmare plays in my head like a record DAILY. Knowing how wrong the system was to what they did and how they did literally blows my mind. I AM A MOTHER WHO HAD MY SON STOLEN FROM ME. I want JUSTICE and I want my baby back.

  5. This has gone on long enough. Several loving families are victim to this persecution and injustice. My children were wrongly removed and have suffered greatly emotionally and physically. America is quickly turning into a restricted country rather than a democracy. When the government kidnaps our children for money something is seriously wrong….

  6. I don’t think it’s right that they just walk up in your house and say we taking your children and for no reason just because someone said something that wasn’t true. Now my grandbaby’s are separated from their parents and they can’t get them back because they can’t afford a lawyer.

They are dying being sex trafficked my granddaughter still suffers from PTSD even after being home for 7 years after being placed in a abusive foster home along with her sister. 2 more grandchildren are in foster care one day after birth and sister was 2 this has to stop! Whats it going to take to get the right people to step in!!!

  7. It’s been since 2013 when they toke my kids.. and it was an open adoption but we went in front of the judge and he went against us…. and I didn’t sing no papers to make it close… I just want pics that’s all so I can see for myself that they r okay

  9. PLEASE HELP – they took my 11yr old for something he did at 10, then at 13 whisked him 690 miles away to a facility in Arkansas that is under investigation for child abuse and neglect….I WANT HIM HOME – this is torment for him and for me!!!

  13. The cps program and its motive needs to be reassessed and up dated to a more modern way of functioning..
    as well as all employees should have a annual review as well as all cases, and if that sounds like they may need a better hiring ratio then they need to get a jump start into it..
    for example if a mother is still fighting for her rights with her children three years well into her case I would highly doubt the average neglectful or abusive parent would still be making an attempt to keep their parenting rights, not to mention if they are still complying with the classes recommended along with still willing to comply with any and all drug testing that cps request for AND PASSING ALL CLASSES AS WELL AS ALL DRUG TESTS.

    Cps only seems to do more damage to families then any good. From what I have researched on their behalf around the country all seem to have very similar issues with all their departments in all of their locations which are sexual abuse along with physical abuse.. for such an organization to be about protecting the children they take for their parents to have been accused and stript from their right because of such accusations just for every single facility of their organizations to have or had some sort of case open or active with such allegations..

    My question is to whom it may concern who do the children go to for proper help from there? Who will help those kids? Who will help protect the children from the monsters within the cps system? Or the monsters whose home they might get placed in??

    What happened to the ppl who are in touch with their moral and ethics, not to mention common sense to work with these children who have just been Strip from the only ppl they knew?

  14. My daughter 16 was caught sneaking out and being apart of an adult porn chat group on snap chat with older adults. My daughter has a history of DV in the home because of her father that has had 4 marriages and 3 DV orders since. She has tried to kill herself and is a cutter.
    Long story short, when I tried to get my daughter to go to the sheriffs dept she acted out and attacked me, I was 19 weeks pregnant with a high risk pregnancy.
    I defended myself and pushed her off me, she tripped over her drum set and cut her eyebrow on the door jam. Tried to run out the door to run away because she said her friends done nothing wrong and were not going to jail, all I could grab was the back of her shirt and grabbed hair with it. She felt down on the steps trying to swing at me hitting her face and head.
    My 7 yr old son was upstairs asleep on the main level, never woke up.
    She got away and ran to the neighbors and said I was trying to kill her with a baseball bat.
    They believed her while the sheriff and DA not once but twice were asked to press charges. They did not press charges saying it was self defense.
    DSS took both of my children saying I beat her and I have not set foot in front of a judge due to every time, 3 times now, Court has been continued.
    I get one day a week with my son and have been forbidden to talk to my daughter who is now with her abusive father. I am an RN with no record and he has three DV orders and 2 50Bs.
    How!!!!
    My son who lives with a separate father tells the GL that he misses me and wants to come home, all of the other caseworkers that have worked with us see no danger and have no clue as to why my son was even took and say that the investigator was Known for making things worse than what they are.
    6 months and my daughters DSS therapist has not even tried to contact me, they said she was not ready and was scared of me.
    According to other parents she is at her high school bragging about calling the law and said she wanted to teach me a lesson that none of her friends ( the older ones in the porn) were gonna go to jail!
    With almost 8 years of medical records and FACTS on file they did not listen to a word I said.
    My daughter now has an implant in her arm with a Snapchat post that said “ let the body counts began!” While she puffed on her vape.
    Heaven help my daughter! And bring home my son! CPS needs to step down and let the REAL detectives take charge!

  16. I was a Caseworker assistant. I’ve seen many great workers who have the familie’s best interests at heart but too often those great workers are driven off and do not last because the system thrives in being “Broken” they (CPS Mafia) can not thrive and cash in if the system is fixed and all families and children kept together. Here in the State of Texas too many arrogant college Grads who did not major in SocialWork ( hence they DO NOT care enough for other humans) and have no intention in staying within that field are hired on simply because they have a 4 year degree and use CPS as a stepping stone to simply get the job they actually study for. I’ve seen these adults with Criminal Justice degrees, AGRICULTURAL degrees NOT Psychology Degrees take children from their parents! What does someone with no parental experience, who studied Agriculture know about the psychological, physical and medical needs of a child or a family as a whole!?
    We have too many pompous physicians and arrogant caseworkers who believe they must take children from their loving homes sumply because a parent does not follow their advice and it needs to stop.

  17. We need help getting our children back who were wrongfully “removed” and things have been dragged out and about for over 4 years, now. Nothing we do is good enough for the kidnappers (family court) and our opposition is the SALVATION ARMY who are tight with everyone involved – CPS, social workers, etc.
    We have an attorney and a custodial child born after the removal.

  18. 18 years ago I lost my daughter to the Department of Human Resources CPS and I never got to see her again has been a pain in my heart for 18 years is not a day that goes by that I don’t think about my daughter Brianna

If it is so easy to take kids for the wrong reason or false reasons, then why did Missouri’s DFS refuse to take our grandchildren out of a home with violent drug abusers, no food, no electric, and no heat in 20 degree weather, when we, their grandparents, were willing to take them into our stable, nurturing home? We called DFS several times over 3 1/2 years. They did nothing. They left our grandchildren at the mercy of violent meth users and meth dealers. We tried to ake them out of that house and were forced by DFS and the polcie to take them back. They endured so much trauma because of the pathetically low standards that DFS requires of parents. We had to get an attorney and take our case in front of the judge in order to protect our grandchildren from further abuse and neglect. The judge was appalled at the conditions the childrn were living in. The judge granted us emergency guardianship immediately upon hearing our case and he granted permanent guardianship to us within 90 days. After this experience, I find it difficult to believe that DFS would take kids unnecessarity, if they won’t even take them when there is obvious and extreme abuse and neglect.

    1. This is the pattern that we see over and over — children who are truly in need of protection are left bt CPS in awful situations, but childrn who are loved and cared for in their homes are taken away.

      Why?

      It comes down to funding. Because the bulk of the federal dollars come to the state based on the model of “remove, foster, and adopt,” social workers look for children who are ultimately “adoptable.” They consider children who are truly abused to be “damaged goods” who are “unadoptable.” They also did not get funding when children went to family members, only strangers.

      The Family First bill is beginning to go into effect, and some of the funding is shifting from the current social worker model of removal, placement with strangers, with the ultimate goal of adoption by strangers. Hopefully we will see social workers ahift to helping the children like your grandchildren who truly need help.

  21. They do this many ways. CPS was weaponized against me through my wife’s family. Such a sad and tragic ending. Somehow I even am accused of neglecting a child that I never met. All of CPS have lied and committed perjury. The treasonous judge fraudulently claims that she can’t hold anyone accountable for perjury. We need to stop these “private” businesses from stealing our kids.

  22. My son was among the first victims of ASFA 1997. We were notified in late February that he (then age 16 and in my care) was the father of a then approximately 2 year old girl and asked if he wanted custody. He did not hesitate in saying yes.

    We were told that a caseworker from CPS would contact us to let us know what we would need to do in order to obtain custody.

    Within a two week period he was duped into signing a piece of paper in an attorneys’ office (without my presence) and led to believe that he was signing “emancipation” papers.

    He recounts that he had no sooner signed the paper than the attorney (Bonnie Gunden) snatched it up and declared that he had just signed away his parental rights and that the state of Texas did not want mixed-race families and had his daughter been a “few shades lighter” they would have let him have her.

    The events that led to this are complicated but the basic facts are that the attorney had no right calling him into her office to discuss any legal matters without my being present, that the document she provided the court was obtained under false pretenses and obtained while my son was under duress.

    This event happened in March of 1998 and it was not until his daughter found him that we began to unravel the series of events that led to both his and her being kidnapped in order for the State to get its’ 30 pieces of silver.

    We have tried for the past three years to find someone to help us file a “falsification of judicial paperwork” in oder to convince his daughter that he wanted her.

    She was told that he “hated her and her mother because of their skin tone and that the entire family were racist” as a means to discourage her from seeking her father out. I consider this to be a form of emotional and mental abuse perpetrated on my granddaughter. The accusation, which is unfounded, is also slanderous towards my son and our family.

    We need Federal level help in seeing the perpetrators of these crimes are appropriately tried for their crimes. And that we are granted the right to defend ourselves against the lies contained within court documents.

  23. Each generation struggles more than the one prior. Trauma is passed down. The amount of trauma CPS and family court are putting people through is sure to destroy several generations after they are finally destroyed. The sooner the better. The only ones who benefit from family court and CPS are the criminals. Want to reduce mass shootings, rapes, homicides….. get rid of family court and CPS. Stop giving incentives to destroy people and start giving incentives for good life decisions.
